Marine Group Boat Works Premise Access Agreement

In consideration for Marine Group Boat Works, LLC (“MGBW”) allowing me access to their premises (the “Premises”) for the purpose described below, I agree as follows: (1) I understand that dangerous and hazardous conditions exist upon the Premises that can result in serious bodily injury, including death, and property damage. (2) I accept any and all risks of injury, death or property damage. (3) Neither I nor my spouse, heirs, successors or assigns will make a claim against MGBW or any of its representatives, successors or assigns, for injury, death or property damage resulting from the negligence or other acts, howsoever caused, by MGBW or any of its representatives, employees, agents, contractors, invitees or guests, as a result of my access to the Premises. (4) I, on behalf of myself, my spouse, heirs, successors and assigns, hereby release, discharge and waive the right to bring any action, claim or demand that I, my spouse, heirs, successors and assigns now have or may hereafter have for injury, death or property damage resulting from my access to the Premises, with the sole exception thereto being intentional acts on the part of MGBW or any of its representatives, successors or assigns. (5) If any action is brought to enforce the provisions of this agreement, the prevailing party shall be entitled to recover its attorneys’ fees and costs.
